In this regard, activities and actions that constitute a threat to the environment can be regarded either from a civil or a criminal perspective. The present lecture will analyse until what extent the 2004/35/CE Directive may allow a criminal prosecution of the person or entity causing the damage or it is a action reserved to the countries itself.
