The current situation of the marine ecosystems have provided for different studies as a result of some hazard activities caused by humans that have increased the risk of extinction of different species in certain areas such as the Gorgonies. In this regard, activities and actions that constitute a threat to the environment can be regarded either from a civil or a criminal perspective. The present lecture will analyse until what extent the 2004/35/CE Directive may allow a criminal prosecution of the person or entity causing the damage or it is a action reserved to the countries itself.
