Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data known as GDPR (General Data Protection Regulation) brings some new aspects of personal data protection. Fundamental task for the Czech Office for Surveying, Mapping and Cadastre (ČÚZK) was to find out how the current forms of data provision will be influenced by the rules and principles of this regulation. A working group composed of lawyers, IT experts and practitioners on user services has analyzed impact of the regulation in the first half of the year 2018 with following results. There is no limitation of spatial data provision currently run by ČÚZK concerning GDPR. National legislation (Basic Registers Law 111/2009) even requires, that content of the Basic Register of Territorial Identification, Addresses and Real Estates (RÚIAN) will be provided as Open Data. This data are almost identical with INSPIRE themes Cadastral Parcels, Buildings, Addresses and Administrative Units, so existing free INSPIRE download services and free provision of digital cadastral maps will be not influenced by GDPR. On the other side, it is necessary to make essential changes in the exchange format of the written part of the cadastral information, which is provided in a file form, to comply with the GDPR principle of adequacy. These files currently contain personal data of the owners and other entitled persons. Newly only identifier of the person linked to the cadastral agenda will be provided inside the exchange format. The user will be able to obtain personal data if necessary using this identifier in a new web service. The service will be available to the registered users only and will be carefully monitored. Suspicion on misuse of the service will be reported to the Office for Personal Data Protection.
